LICENSE
By receiving and opening the file package, and/or using this ‘NIPUN Maharashtra’ software, you agree that this End User License Agreement (EULA) is a legally binding and valid contract and you agree to be bound by it. You agree to abide by the intellectual property laws and all of the terms and conditions of this Agreement. Subject to the terms of this Agreement, ‘NIPUN Maharashtra’ grants you a limited, non-exclusive, non-transferable license, without right to sub-license, to use ‘NIPUN Maharashtra’ app in accordance with this Agreement. ‘NIPUN Maharashtra’ does not transfer the title of ‘NIPUN Maharashtra’ app to you; the license granted to you is not a sale. This agreement is a binding legal agreement between ‘NIPUN Maharashtra’ and the users of ‘NIPUN Maharashtra’. If you do not agree with this agreement, delete the ‘NIPUN Maharashtra’ from your computer/Mobile/Tablet now.
Its valid for the time the user wishes to use this application by abiding this agreement and for educational purposes only.
There is no registration fees or any kind of fees to use this software.
This software is solely for student, teacher welfare and educational purpose promoted by SCERT, Pune as per MOU between VOPA and SCERT, Pune.

DISTRIBUTION
‘NIPUN Maharashtra’ and the license herein granted shall not be copied, shared, distributed, re-sold, offered for re-sale, transferred or sub-licensed in whole or in part without our permission. For information about redistribution of ‘NIPUN Maharashtra’, contact ‘Vowels of the People Association’.
USER AGREEMENT
Use
Your license to use ‘NIPUN Maharashtra’ app is limited to the number of permits authorized to be used by you. While using ‘NIPUN Maharashtra’ or any of the educational apps/products the user agrees all the terms and conditions stated in this document and also agrees with the Privacy Policy stated here. If you do not agree with any of these, you should not use ‘NIPUN Maharashtra’.
Use Restrictions
You shall use ‘NIPUN Maharashtra’ app in compliance with all applicable laws in India and abroad for respective laws of land in country where it is used and not for any unlawful purpose. Without limiting the foregoing, use, display or distribution of ‘NIPUN Maharashtra’ together with material that is racist, vulgar, obscene, defamatory, libelous, abusive, promoting hatred, discriminating or displaying prejudice based on religion, ethnic heritage, race, and sexual orientation is strictly prohibited.
Copyright
This Software displays images, videos etc. from world wide web for educational and non-profit purpose only. Vowels of the People Association (VOPA) or ‘NIPUN Maharashtra’ does not sell, distribute for profit, possess intellectual right, claim ownership of any of the content seen in this software that is not made by Vowels of the People Association. Vowels of the People Association, SCERT, Pune and ‘NIPUN Maharashtra’ do not build monetary profits from this software or any digital material used in this software.
The educational material made by ‘NIPUN Maharashtra’, its associates or Vowels of the People Association and available on this software is free to be used, modify, rebuild for the educational and non-profit purposes only. If the content builder teacher has used any copyrighted material in their lesson or video or anywhere on the ‘NIPUN Maharashtra’ App it is their sole responsibility to face any consequences arising out of it. Furthermore if any such content is used by any content builder/teacher unknowingly of copyright laws, we request the original owner of that content to contact us to remove such content if they wish that. We will immediately remove such content if the content owner doesn’t wish to allow their content being used for educational and Non-profit purpose at ‘NIPUN Maharashtra’.
‘NIPUN Maharashtra’’s name, logo and graphics file that represents ‘NIPUN Maharashtra’ shall not be used in any way to promote other products. ‘NIPUN Maharashtra’ retains sole and exclusive ownership of all right, title and interest in ‘NIPUN Maharashtra’ software. No program, code, part, image, audio sample, or text may be copied or used in any way by the user except as intended within the bounds of the single user program. All rights not expressly granted hereunder are reserved for ‘NIPUN Maharashtra’.
Limitation of Responsibility
You will indemnify, hold harmless, and defend ‘NIPUN Maharashtra’, Vowels of the People Association, its employees, agents and distributors against any and all claims, proceedings, demand and costs resulting from or in any way connected with your use of ‘NIPUN Maharashtra’ App. In no event (including, without limitation, in the event of negligence) will ‘NIPUN Maharashtra’, its employees, agents or distributors be liable for any consequential, incidental, indirect, special or punitive damages whatsoever (including, without limitation, damages for loss of profits, loss of use, business interruption, loss of information or data, or pecuniary loss), in connection with or arising out of or related to this Agreement, ‘NIPUN Maharashtra’ or the use or inability to use ‘NIPUN Maharashtra’ App.
Warranties
Except as expressly stated in writing, ‘NIPUN Maharashtra’ makes no representation or warranties in respect of this Software and expressly excludes all other warranties, expressed or implied, oral or written, including, without limitation, any implied warranties of merchantable quality or fitness for a particular purpose.
Governing Law
This Agreement shall be governed by the law of Pune, Maharashtra, India as applicable therein. If any provision shall be considered unlawful, void or otherwise unenforceable, then that provision shall be deemed severable from this License and not affect the validity and enforceability of any other provisions.
Termination
Any failure to comply with the terms and conditions of this Agreement will result in automatic and immediate termination of this license. Upon termination of this license granted herein for any reason, you agree to immediately cease use of ‘NIPUN Maharashtra’ and delete /remove all copies of ‘NIPUN Maharashtra’ supplied under this Agreement.
DISCLAIMER OF WARRANTY
THE SOFTWARE IS PROVIDED “AS IS”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.
CONSENT OF USE OF DATA
You agree that ‘NIPUN Maharashtra’ may collect and use information gathered in any manner as part of the product support services provided to you, if any, related to ‘NIPUN Maharashtra’. ‘NIPUN Maharashtra’ may also use this information to provide notices to you which may be of use or interest to you. For details please refer the privacy policy of ‘NIPUN Maharashtra’. ‘NIPUN Maharashtra’ may use SMS or/and WhatsApp as a medium of providing and collecting data, feedback, insights, and nudges to the users.
